GHP works to keep this site usable and accessible, but the site is provided “as is” and availability or display may vary by device, browser, settings, or assistive technology. GHP may update, pause, or remove site content at any time. GHP is not responsible for issues caused by third-party services or links (including embedded tools, hosting, analytics, and external websites).

Sales tax may apply to your order depending on the deliverables and your location. When required, applicable state and local sales tax will be added at checkout or included on your invoice.

In North Carolina, certain digital products delivered electronically (including digital media such as photography, video, and similar) are subject to sales and use tax.

By using or uploading any images or media provided, the client acknowledges acceptance of the work and agrees to the following terms.

If you’re not satisfied with the delivered media and have not used, published, or uploaded it in any form, please reach out within 72 hours of delivery. I will take the time to understand your concerns and may offer to address them through re-editing or, when appropriate, a reshoot at no additional charge.

If you prefer not to move forward with revisions, or if we’re unable to reach a satisfactory outcome, a full refund will be issued, provided that the media has not been used, published, or uploaded to any platform, including MLS, listing websites, social media, marketing materials, or third-party services.

Once any media is used, published, or uploaded in any form, the work is considered accepted and is no longer eligible for refund.

Refund requests made after 72 hours from delivery are not eligible.

If a refund is issued, all licensing rights are immediately revoked. The client agrees to remove and permanently delete all media and any derivatives from all platforms, storage locations, and marketing materials. Any continued use of refunded media is strictly prohibited and will be subject to legal action to the fullest extent permitted by law.

Ownership:

All images and media are protected by copyright and remain the property of GHP unless otherwise agreed in writing.

For-Sale Listing License:

GHP grants a limited, non-exclusive, non-transferable license to the listing agent who commissioned the work, and to other licensed agents within the same brokerage, solely for the purpose of marketing the property for this sale of the property. This includes use across all marketing channels related to the listing, including MLS, agent, brokerage, and property websites, third-party listing platforms, social media, email marketing, print materials, brochures, and editorial placements intended to promote the property. The license remains in effect for the duration of the listing and any subsequent re-listings of the same property by the same brokerage for the same sale effort, and terminates upon final sale of the property or transfer of the listing to a different brokerage, except as otherwise stated.

Short-Term Rental License:

When services are commissioned for short-term rental marketing, GHP grants a limited, non-exclusive, non transferable license to the client to use the images to market the property as a short-term rental on platforms such as Airbnb, VRBO, and similar channels, as well as the client’s own website, social media, and related promotional materials. The client may authorize property managers, co hosts, or marketing partners to use the images on their behalf solely for the purpose of marketing the client’s property. This license does not permit transfer of ownership, resale, or independent use of the images by any third party, and all use remains under the control and responsibility of the original client unless otherwise agreed in writing.

Restrictions:

The license is limited to the authorized party as defined in the applicable license. It does not extend to agents, brokerages, or parties outside that scope without written permission from GHP.

The images may not be transferred, assigned, or sub-licensed except as expressly permitted within the applicable license.

The images may not be used to market the property in any future sale, listing, or transaction without a new license.

The images may not be sold, licensed, or otherwise distributed as standalone assets.

Use of the images outside the defined scope of the applicable license is prohibited without prior written permission from GHP.

Permitted Modifications:

Licensed parties may crop, resize, and make reasonable adjustments necessary for marketing use, including virtual staging, virtual twilight, object removal, and similar alterations, provided the images are not used in a misleading manner.

Accuracy & Representation Responsibility:

All responsibility for the accuracy and representation of the property in any marketing materials rests solely with the listing agent, brokerage, or licensed client. GHP is not responsible for any inaccuracies, omissions, alterations, or misrepresentations of the property, whether arising from editing, post-production, third-party modifications, or the use of the images in marketing materials. The licensed party is solely responsible for ensuring compliance with all applicable laws, regulations, and MLS requirements.

Attribution:

Photographer credit is appreciated but not required.

Promotional Use:

GHP retains the right to use all images for portfolio, marketing, social media, awards, and promotional purposes. Any embargo, confidentiality requirement, or delayed release must be communicated and agreed upon in writing prior to the shoot.

Additional Licensing:

Any use outside the scope defined in the applicable license requires a separate license. For additional usage, please contact GHP to discuss licensing.

GHP reserves the right to license the images for any other use, including future listings, commercial use, or third-party marketing, unless otherwise agreed in writing.
